Terms of service

Effective 25 July 2026Last updated 25 July 2026Version 2.3

Operator: Storm Force LLC, a Delaware limited liability company ("Storm Force," "we," "us," or "our"), with principal offices at 440 North Barranca Avenue #3979, Covina, California, United States of America.

01READ THIS FIRST — IMPORTANT NOTICES

THIS IS A LEGALLY BINDING AGREEMENT. Please read it carefully. The following provisions materially affect your legal rights:

§27 (LIMITATION OF LIABILITY) caps our total liability to you.

§28 (DISCLAIMER OF WARRANTIES) provides the Service "AS IS."

§30 (MANDATORY ARBITRATION; CLASS-ACTION WAIVER; JURY-TRIAL WAIVER) requires you to resolve most disputes through individual binding arbitration and waives your right to a jury trial and to participate in any class action. You may opt out within 30 days of first acceptance as set forth in §30.4.

§15 (AI-SPECIFIC DISCLAIMERS) explains that the Service is artificial intelligence, may produce inaccurate outputs, is not a person, and is not a substitute for professional advice.

§17 (NO PROFESSIONAL ADVICE; CRISIS RESOURCES) addresses medical, legal, financial, and mental-health-crisis situations.

§32 (1-YEAR–2-YEAR LIMITATIONS) shortens the deadline to bring claims.

You must be at least 18 years old. The Service is for adults only.

EU/UK/EEA/Swiss/Australian/Brazilian users: nothing in these Terms removes or limits your non-waivable consumer-law rights. See §47 (EU/UK/EEA/Swiss Addendum) and §48 (Other Jurisdiction Addenda).

02Acceptance; E-Signature

By creating an account, clicking "I agree," accessing, or using the Service, you agree to these Terms and to our Privacy Policy and Acceptable Use Policy ("AUP"), each incorporated by reference. You consent under the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN), the Uniform Electronic Transactions Act (UETA) where applicable, eIDAS Regulation (EU) 910/2014 (where applicable), and equivalent local laws to enter into these Terms electronically and to receive all notices, disclosures, and communications electronically. You may withdraw e-record consent at the cost of terminating use of the Service.

03Definitions

"Service" means the Bruner AI-powered Socratic learning/tutoring software-as-a-service, including the website, mobile applications, AI Outputs, credit/top-up balances, beta features, and any related services.

"Output" means any text, audio, image, code, or other content generated by the Service in response to your prompts or inputs.

"User Content" means anything you submit to, upload to, or generate through the Service, including prompts, inputs, files, audio, and account information (other than Output).

"Subprocessor" includes any third-party AI model provider, infrastructure provider, payment processor (Merchant of Record), or analytics provider listed in our Privacy Policy.

"Merchant of Record" or "MoR" means the third party we designate to act as merchant of record for your purchase.

04Eligibility; 18+ Only

You represent that (a) you are at least 18 years old and have full legal capacity to enter into these Terms; (b) you are not subject to a court-ordered guardianship that would limit your capacity to contract; (c) you are not a person with whom we are legally prohibited from doing business under applicable sanctions or export-control laws (including OFAC SDN List, EU sanctions lists, UK consolidated sanctions list); (d) your use of the Service does not violate any law applicable to you. The Service is not intended for, and may not be used by, persons under 18. If we become aware that an account holder is under 18, we will terminate the account and (where required) delete associated data.

05Account Registration

You will provide accurate, complete, and current registration information and update it as needed. You are responsible for safeguarding your credentials and for all activity under your account. Multi-factor authentication is strongly recommended. You must notify us within 24 hours of becoming aware of any unauthorized account access. Failure to do so does not by itself create liability against us, and you remain responsible for charges incurred prior to your timely notice except to the extent applicable law requires otherwise.

06Modification of Terms

We may modify these Terms. For material modifications, we will give notice at least 30 days before the effective date by email and in-product notice. Continued use after the effective date constitutes acceptance. If you do not accept, your sole remedy is to terminate before the effective date and request a pro-rata refund of unused prepaid fees (excluding consumed top-up credits). Modifications that solely benefit you, are required by law, or are non-material take effect on posting.

07The Service; AI Disclosure

The Service is an AI-powered Socratic learning and tutoring platform. You are interacting with an artificial intelligence system, not a human tutor. This disclosure satisfies our obligations under EU AI Act Article 50(1) and analogous transparency rules. The Service uses third-party large language models from one or more providers, identified in our Privacy Policy. Where required by law, we will identify Outputs as AI-generated.

08Subscriptions; Auto-Renewal; Top-Up Credits

8.1 Subscriptions auto-renew at the end of each term until cancelled. Prices and renewal terms are disclosed at signup and in account settings.

8.2 Express affirmative consent. By activating a paid subscription, you provide express affirmative consent to the auto-renewal terms (Cal. Bus. & Prof. Code §17602, as amended by AB 2863 effective July 1, 2025; analogous state ARLs).

8.3 Click-to-Cancel. You may cancel at any time, online and in the same medium used to enroll (or in any medium in which you are accustomed to interacting with us), without retention prompts that obstruct cancellation. We will provide a prominently located link/button in account settings.

8.4 Annual reminder. We will send an annual reminder of your auto-renewal in the same medium used to enroll, including price, frequency, and how to cancel.

8.5 Fee-change notice. We will give 7–30 days' prior notice of any fee change, with cancellation instructions.

8.6 Free / discounted trials. If a trial converts to a paid subscription, we will give 3–21 days' prior notice as required.

8.7 Top-up credits are a prepaid right to consume the Service; they have no monetary value, are not currency or stored value, are non-transferable, and are not redeemable for cash, except where required by law. Consumed credits are non-refundable except as required by law or as expressly stated. Purchased and promotional credits expire 12 months after they are added to your account. In-app-purchase credits (Apple App Store / Google Play) do not expire. Subscription-included credits follow your plan's terms (see Section 8.1 and our Refund & Cancellation Policy). We send an email reminder before credits expire where you have email notifications enabled. See our Refund & Cancellation Policy.

8.8 Recordkeeping. We retain records of your express affirmative consent for at least 3 years (or 1 year after termination, whichever is longer).

09Merchant of Record

Our order process is conducted by a third-party reseller that acts as our Merchant of Record (MoR) for all our orders and handles billing, payment, order-related inquiries, and returns; the MoR's identity is shown at checkout. The MoR is responsible for taxes, refunds, chargebacks, and invoicing under its own terms, which apply alongside ours; the MoR's refund policy controls for billing disputes. For help with the Service itself, contact us (see §50).

10Refunds; Statutory Rights

10.1 U.S. default: All sales final except as required by law, by the MoR's policy, or as expressly granted by us.

10.2 EU/EEA/UK/CH consumers: You have the right to withdraw within 14 days of contract conclusion under Directive 2011/83/EU. For digital content/services (including subscriptions and Output), you expressly request immediate performance and acknowledge that you lose the right of withdrawal once performance has begun and you have given express prior consent (Art. 16(m)). If we have not obtained both your express request and your acknowledgment of loss-of-withdrawal-right, the right of withdrawal is preserved. For a digital service, the withdrawal right is instead lost only to the extent the service has been performed, with payment due for the proportionate part supplied (Art. 16(a)). Additional EU statutory remedies under Directive 2019/770 (digital content conformity) apply: bring-into-conformity, price reduction, or termination. See our Refund & Cancellation Policy for how this applies to subscriptions and prepaid credits.

10.3 UK consumers: Consumer Rights Act 2015 §§42–47 statutory rights apply.

10.4 Australian consumers: Australian Consumer Law guarantees (ACL §54–§64) apply and cannot be excluded.

10.5 Brazilian consumers: 7-day right of regret under CDC Art. 49 applies.

10.6 App store purchases: Apple/Google in-app purchase refunds follow the relevant store's policy and override this section to the extent inconsistent.

11Pricing

Prices are stated in USD or local currency. We may change prices prospectively with 7–30 days' notice (§8.5). Sales tax / VAT / GST are added as required.

12License to You

Subject to these Terms and your payment of fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial educational use during your subscription term.

13User Content; AI Processing

13.1 Your User Content. You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, reproduce, and create derivative works of your User Content solely to operate, provide, secure, and improve the Service for you and to enforce these Terms.

13.2 No training of our own models; third-party processing. We do not use your User Content or Output to train, fine-tune, or develop our own AI models. To provide the Service, your User Content is processed by the third-party providers described in our Privacy Policy, who handle it under their own terms — which we do not control and which may permit them to use inputs to operate and improve their own services. Do not submit content you would not want processed by a third-party provider.

13.3 Output ownership. Subject to your compliance with these Terms, we assign to you all rights we may have in Output generated for you. Output may be similar across users; we make no warranty of uniqueness, copyrightability, or non-infringement of third-party rights.

13.4 No competing-model training. You may not use Output, Service interactions, or any extracted data to develop, train, fine-tune, distill, evaluate, benchmark, or improve any AI model that competes with the Service, nor to construct any RLHF dataset, evaluation suite, synthetic-data corpus, or model-extraction artifact for such purposes. Reverse-engineering of the Service or any model is prohibited except to the extent prohibition is unenforceable under non-waivable law (see §14.4).

14Acceptable Use; Prohibited Uses

14.1 You will use the Service only in compliance with these Terms, the AUP, and applicable law.

14.2 Prohibited uses (non-exhaustive; full list in AUP, which we may update with at least 7 days' notice for material changes and immediately for clearly illegal content):

Illegal activity; CSAM; weapons of mass destruction guidance; election manipulation; large-scale disinformation; targeted harassment; non-consensual intimate imagery; impersonation; fraud; malware development; circumvention of safety classifiers (including prompt injection, system-prompt extraction, jailbreaks); scraping or automated access except by our published API; stalking; doxxing; biometric identification of third parties; generating advice for self-harm of any person; competing-model training (§13.4).

14.3 Anti-impersonation of Bruner. You will not impersonate Storm Force or Bruner staff, create accounts purporting to be official Bruner support, register confusingly similar domains, or operate fake Bruner social accounts.

14.4 EU reverse-engineering carve-out. Nothing in §13.4 or §14 limits your non-waivable rights under Directive 2009/24/EC Art. 5(3) (study/observation/test) or Art. 6 (decompilation for interoperability) or as recognized by Top System v. État Belge, Case C-13/20 (CJEU Oct. 6, 2021) (decompilation for error correction).

15AI-Specific Disclaimers; Anti-Anthropomorphization

THE SERVICE IS AN ARTIFICIAL INTELLIGENCE SYSTEM. IT IS NOT A PERSON, A FRIEND, A COUNSELOR, A THERAPIST, A LICENSED PROFESSIONAL, OR A SUBSTITUTE FOR HUMAN JUDGMENT. OUTPUTS ARE PROBABILISTIC, MAY BE INACCURATE, INCOMPLETE, OUT-OF-DATE, OR FABRICATED ("HALLUCINATIONS"), AND MAY APPEAR AUTHORITATIVE WHILE BEING WRONG. YOU MUST INDEPENDENTLY VERIFY ANY FACT, SOURCE, CITATION, COMPUTATION, OR RECOMMENDATION BEFORE RELYING ON IT. NO REASONABLE PERSON SHOULD INTERPRET ANY OUTPUT AS A STATEMENT OF ACTUAL FACT ABOUT ANY IDENTIFIABLE PERSON OR ENTITY.

This disclaimer is presented in capitalized text in product as well as here. (See Walters v. OpenAI, LLC, No. 23-A-04860-2 (Ga. Super. Ct. May 19, 2025).)

16No Educational Outcomes Guaranteed

WE MAKE NO WARRANTY THAT YOU WILL ACHIEVE ANY PARTICULAR LEARNING OUTCOME, GRADE, EXAM RESULT, MASTERY LEVEL, CERTIFICATION, ADMISSION, EMPLOYMENT, OR OTHER OBJECTIVE.

Mastery scoring is heuristic and not a professional educational assessment.

17No Professional Advice; Crisis Resources

The Service is not a substitute for licensed medical, mental-health, legal, financial, tax, or other professional advice. Do not act on Output without consulting a qualified professional.

Mental-health and self-harm crisis. If you are experiencing a mental-health crisis or thoughts of self-harm: in the U.S. dial or text 988 (Suicide & Crisis Lifeline); in the UK call 116 123 (Samaritans); in the EU call 112 or your national crisis line. We urge you to access these resources and any and all other crisis resources available to you. You will not use the Service as a crisis intervention tool. Our automated systems may, where they detect a likely crisis, decline to engage or terminate the conversation. By using the Service, you expressly assume the risk of engaging an AI system rather than a qualified professional.

18GDPR Art. 22 Disclosure (Automated Decisions)

The Service may produce automated outputs (including mastery scoring) that are not legally or similarly significant decisions for you under GDPR Art. 22(1). If we ever make an automated decision producing legal or similarly significant effects, we will obtain Art. 22-compliant consent, provide meaningful information about the logic, and give you the right to obtain human intervention.

19Academic Integrity

You will comply with the academic-integrity policies of any institution to which you are subject. We do not authorize and disclaim responsibility for use of the Service to commit academic dishonesty.

20Intellectual Property; Output

Storm Force retains all rights in the Service, the underlying software, models we own, our trademarks, and our content. See §13.3 for Output assignment. Our trademarks may be used only as expressly permitted.

21DMCA / Copyright

Our designated agent for DMCA notices is Storm Force LLC — Attn: DMCA Agent, 440 North Barranca Avenue #3979, Covina, California, 91723, United States of America, dmca@withbruner.com. Counter-notices follow 17 U.S.C. §512(g). We will terminate repeat infringers.

22Privacy; Data Retention

Our Privacy Policy at /privacy governs how we handle personal data, including what we collect, how we use and share it, retention, security, and your privacy rights.

23Service Availability; Beta; Model Changes

23.1 We do not warrant uninterrupted availability. We may modify, suspend, or discontinue any part of the Service.

23.2 Beta / "Labs" / Experimental. Features designated alpha, beta, preview, experimental, "labs," or evaluation are provided AS IS, with no warranty, no SLA, no indemnity, and no refund. We may discontinue them without notice. Output from such features may be of lower quality.

23.3 Underlying-model changes. Our AI model providers may upgrade, deprecate, or change their models without notice; resulting changes in Output behavior do not breach these Terms.

24Suspension; Termination

We may suspend or terminate your account immediately for: violation of these Terms or AUP; suspected fraud or chargeback abuse; legal compulsion; risk to security or other users; non-payment. We will give notice when feasible. You may terminate at any time per §8.3.

25Effect of Termination; Inactivity

On termination, your right to use the Service ends. We will, on request within 30 days, provide a reasonable export of your User Content. Inactive accounts (no login for 12 consecutive months) may be deactivated; we will give 30 days' email notice before deletion of data.

26Bankruptcy; Wind-Down

If we cease operations or commence an insolvency proceeding, we will, where legally permitted, give at least 30 days' email notice, provide a data-export window, refund unused prepaid subscription fees on a pro-rata basis, and honor your data-deletion rights to the extent technically feasible.

27LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

(A) NEITHER STORM FORCE NOR ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, SUBPROCESSORS, OR SUPPLIERS (TOGETHER, "STORM FORCE PARTIES") WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, GOODWILL, USE, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

(B) THE STORM FORCE PARTIES' AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (i) THE TOTAL FEES YOU PAID TO US (OR THE MoR ON OUR BEHALF) IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (ii) ONE HUNDRED U.S. DOLLARS (US$100).

(C) THE LIMITATIONS APPLY DESPITE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.

(D) Carve-outs. The cap and exclusions in (A)-(C) do not apply to: (i) liability that cannot be limited under applicable law (including fraud, willful misconduct, gross negligence, death or personal injury caused by negligence in jurisdictions where so required, and Cal. Civ. Code §1668); (ii) your indemnification obligations under §29; (iii) infringement of our intellectual property; (iv) violation of §13.4 (no competing-model training) or §14 (Acceptable Use); (v) your payment obligations.

(E) Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent any limitation is unenforceable, our liability will be limited to the maximum extent permitted.

This is an essential element of the bargain; absent these limitations, prices would be materially different.

28DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE STORM FORCE PARTIES DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND TITLE. WE MAKE NO WARRANTY ABOUT OUTPUT ACCURACY, FACTUALITY, COMPLETENESS, OR FITNESS, OR ABOUT LEARNING OUTCOMES.

Some jurisdictions do not allow the exclusion of implied warranties; in those jurisdictions, the foregoing exclusions apply to the extent permitted, and statutory rights are preserved.

29Indemnification

You will indemnify, defend, and hold harmless the Storm Force Parties from claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of: (a) your User Content; (b) your use of Output; (c) your breach of these Terms or AUP; (d) your violation of law or third-party rights. We may assume sole control of defense; you will reasonably cooperate.

30MANDATORY ARBITRATION; CLASS-ACTION WAIVER; JURY-TRIAL WAIVER

PLEASE READ CAREFULLY. THIS SECTION GOVERNS HOW DISPUTES BETWEEN YOU AND STORM FORCE ARE RESOLVED.

30.1 Informal resolution required. Before filing arbitration, you and we will attempt informal resolution: send written notice to legal@withbruner.com describing the dispute and requested relief; we will respond within 60 days. If unresolved after 60 days, either party may proceed.

30.2 Mandatory arbitration. Any "Dispute" between you and Storm Force, regardless of when it arose (including before these Terms), arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules and the Consumer Due Process Protocol, including the AAA Mass Arbitration Supplementary Rules effective May 1, 2024 where applicable. The arbitration will be in English. The seat of arbitration will be your county of residence (US users) or as otherwise determined under AAA rules (non-US users not subject to §47/§48).

30.3 CLASS-ACTION WAIVER; JURY WAIVER. YOU AND STORM FORCE WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION, EXCEPT AS PROVIDED IN §30.7 (PUBLIC INJUNCTIVE RELIEF). THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING EXCEPT AS SET FORTH IN §30.5.

30.4 30-day opt-out. You may opt out of arbitration by sending notice to arbitration-optout@withbruner.com within 30 days of first accepting these Terms (or of any material modification of this §30) including your name, account email, and an explicit statement that you opt out. Opting out does not affect any other provision.

30.5 Mass arbitration procedures. If 25 or more substantially similar arbitration demands are filed against us within a 60-day period by or with the assistance of the same law firm, group of law firms, or coordinated organization, the parties agree the AAA will administer those demands using AAA's Mass Arbitration Supplementary Rules, including a single Process Arbitrator, batching of cases (no more than 100 per batch), and consolidated procedural rulings, modeled on the framework approved in Jones v. Starz Entertainment, LLC, No. 24-1645 (9th Cir. Feb. 28, 2025). No claimant is bound by any merits ruling in another claimant's batch absent that claimant's actual participation. (See Heckman v. Live Nation Ent., Inc., 120 F.4th 670 (9th Cir. 2024).) Filing fees will be allocated per AAA rules.

30.6 Severability of arbitration.

(a) The class-action waiver in §30.3 is non-severable from individual arbitration: if §30.3 is held unenforceable as to a particular claim, that claim alone proceeds in court; the arbitration of all other claims continues.

(b) If any other portion of §30 is held unenforceable, that portion is severed; the rest of §30 survives.

(c) §30.7 (public injunctive relief) is non-severable and survives in court.

30.7 Public injunctive relief carve-out (McGill rule). Notwithstanding any other provision, claims for public injunctive relief as defined in McGill v. Citibank, N.A., 2 Cal. 5th 945 (2017) may be brought in a court of competent jurisdiction. This carve-out is intentional, material, and non-severable.

30.8 Small-claims court. Either party may bring an individual claim in small-claims court if the claim qualifies and remains in that court.

30.9 Injunctive IP relief. Either party may seek temporary or preliminary injunctive relief in court to protect intellectual property pending arbitration.

30.10 Confidentiality. The arbitration award may be designated confidential. Nothing in these Terms restricts a party from disclosing or discussing the existence or substance of a Dispute, communicating with witnesses, regulators, or counsel, or making any disclosure required or permitted by law.

30.11 No fee-shifting against consumer. We pay AAA fees as required by AAA Consumer Rules. We will not seek attorneys' fees against you except for claims a court or arbitrator finds frivolous (28 U.S.C. §1927 standard) or for IP claims.

30.12 Coordination with other contracts. These Terms govern any Dispute between you and us, including disputes relating to ancillary contracts (e.g., promotions, contests). To the extent any ancillary contract conflicts with this §30, this §30 controls unless the ancillary contract expressly states otherwise. (See Coinbase v. Suski, 602 U.S. 143 (2024).)

31Governing Law; Venue

The Federal Arbitration Act governs §30. Otherwise, these Terms are governed by Delaware law (without regard to conflicts). For disputes not subject to arbitration, exclusive venue is the state and federal courts in Delaware, except (a) consumer-protection statutes of your home jurisdiction continue to apply where mandatory; (b) for EU/UK/EEA/Swiss/AU/BR consumers, see §47–§48.

32Limitations Period

You must bring any claim within two (2) years of accrual or be forever barred, except where applicable law prohibits shortening (e.g., Va. Code §59.1-508.5(b)(2)) or expressly provides a different period.

33Third-Party Services

The Service integrates third-party AI models, payment processors, and infrastructure. Your use of those services is subject to their terms.

34Force Majeure

Neither party is liable for failure or delay due to events beyond reasonable control, including acts of God, war, terrorism, civil unrest, labor action, pandemic, government order or regulation (including AI-related regulation), sanctions, cyberattack, ransomware, internet/CDN/telecom failure, undersea-cable disruption, AI model provider termination or material change of API access, and similar events.

35Communications Consent; TCPA / SMS / AI Voice

35.1 Transactional communications. By providing your contact information, you consent to receive transactional communications related to your account.

35.2 Marketing. We will only send marketing SMS or AI-voice calls with your prior express written consent, satisfying TCPA requirements as amended by FCC FCC-23-107 (one-to-one consent, eff. Jan. 27, 2025) and FCC 24-17 (AI-voice as "artificial," eff. Feb. 2024). Marketing messages will identify the sender and provide STOP and HELP keywords; you may revoke consent in any reasonable manner and we will honor revocation across all channels within the period required by FCC 24-24 (eff. Apr. 11, 2025).

35.3 AI-voice disclosure. Where we use an AI-generated voice in any call, we will disclose that fact at the outset.

36Chargebacks; Fraud

Initiating a chargeback for a charge you authorized may result in account suspension or termination and recovery of chargeback fees and reasonable costs. Threatening a chargeback or public defamation as leverage to obtain service constitutes a material breach.

37Multi-Account; Abuse Detection; Anti-Fraud

You will not create multiple accounts to evade rate limits, suspensions, or referral economics. We may use automated tools to detect abuse and may suspend or terminate accordingly.

38Referrals; Promotions; Reviews

38.1 Referral fraud. We may claw back referral credits and reverse rewards from fraudulent, self-, or duplicate referrals, or from chargeback-adjacent activity.

38.2 Promotions are subject to additional rules; in case of conflict, this ToS §30 controls dispute resolution unless promotion rules expressly say otherwise.

38.3 Reviews. You will not post fake or compensated-without-disclosure reviews about Bruner. We comply with FTC 16 CFR Part 465 (Consumer Reviews and Testimonials Rule, eff. Oct. 21, 2024). We do not suppress legitimate negative reviews; we may remove reviews that are fake, off-topic, or violate law or these Terms.

39Export Controls; Sanctions

You will comply with U.S. EAR/ITAR/OFAC, EU dual-use regulations, UK export controls, and other applicable export and sanctions laws. You represent you are not on any restricted-party list.

40Government Users (FAR/DFARS)

If you are a U.S. government end user, the Service is "commercial computer software" and "commercial computer software documentation" with rights as set forth in FAR 12.212 / DFARS 227.7202.

41Notices; Lawful Process

Notices to us: 440 North Barranca Avenue #3979, Covina, California, 91723, United States of America; copy to legal@withbruner.com. We may give notice to you by email or in-product. Government legal process: we will, where legally permitted, give you notice before producing your data; we reserve the right to challenge facially overbroad demands.

42Assignment

You may not assign these Terms without our consent. We may assign without consent in connection with a merger, acquisition, financing, or sale of assets.

43Security Research / Coordinated Vulnerability Disclosure

Good-faith security research is permitted under our published CVD policy at withbruner.com/security, which provides safe-harbor for: testing on your own account; not accessing other users' data; not degrading the Service; reporting to security@withbruner.com before disclosure; and complying with embargo periods. Outside that scope, you may not test or probe the Service.

44Anti-Tampering; Anti-Circumvention

You will not (a) circumvent any technological protection measure (DMCA §1201; analogous laws); (b) violate the Computer Fraud and Abuse Act, 18 U.S.C. §1030; (c) scrape or use automated agents except via our published API and within published rate limits; (d) extract, distill, or otherwise misappropriate model weights, system prompts, or training data; (e) impersonate another user or Bruner. Where actual damages are difficult to compute, liquidated damages of US$5,000 per violation may apply, in addition to other remedies; the parties agree this is a reasonable estimate of those damages and not a penalty.

45Deceased Users (RUFADAA)

On valid notice of death and provision of legal documentation: (a) if you used an in-product legacy/inactive-account tool, those settings control; (b) otherwise, we will follow lawful instructions in a will, trust, or court order, providing access "reasonably necessary" for estate administration consistent with the Revised Uniform Fiduciary Access to Digital Assets Act and the Stored Communications Act, 18 U.S.C. §2702; (c) absent (a) or (b), the account terminates 12 months after death-notification and data is deleted.

46Severability; Misc.

If any provision is held unenforceable, the rest remains in effect (subject to §30.6 as to arbitration). No waiver unless written. These Terms, the AUP, and the Privacy Policy are the entire agreement on the subject. Headings are for convenience only.

Interpretation. The words "include," "includes," and "including" mean "including without limitation" and introduce illustrative, non-exhaustive examples; no enumeration limits the generality of any words preceding or following it, and the rule of ejusdem generis does not apply. Every right, remedy, license, and discretion reserved to us is non-exhaustive and cumulative with all others available at law, in equity, or under these Terms, the AUP, or the Privacy Policy.

47EU / UK / EEA / Switzerland Addendum

47.1 Mandatory consumer law preserved. Nothing in these Terms removes or limits your non-waivable rights under EU/UK/EEA/Swiss consumer law, including under Directive 2011/83/EU (CRD), Directive 2019/770 (DCD), Directive 93/13/EEC (UCTD), UK Consumer Rights Act 2015, and Brussels I-bis Regulation 1215/2012 / Rome I Regulation 593/2008 (consumers may sue in their domicile and benefit from local mandatory law).

47.2 Liability. §27 and §28 apply only to the extent permitted; gross negligence, willful misconduct, fraud, and personal-injury liability are not capped or excluded.

47.3 Withdrawal right. §10.2 controls.

47.4 Forum. EU/UK/EEA/Swiss consumers may bring proceedings in the courts of their domicile under Brussels I-bis Art. 17–19.

47.5 AI Act Art. 50 transparency. §7 satisfies the disclosure that you are interacting with AI. Where required by law, we will mark AI-generated Output as artificially generated.

47.6 Digital Services Act. §41 includes our DSA Art. 11 point of contact. Notice-and-action requests at dsa@withbruner.com per Art. 16.

47.7 Scope of the service. Bruner's intended purpose is individual, self-directed study; it is not intended for use by or within educational or vocational training institutions.
